1. Introduction

Welcome to Blink Tuning (“Blink”, “we”, “our”).

By accessing or using https://blinktuning.com (“Website”), purchasing any Blink Tuning product, or using any Blink Tuning service, you (“you”, “the Customer”) agree to be bound by these Terms of Service.

If you do not agree with these Terms, please discontinue use of the Website and do not purchase Blink Tuning products or services.

2. Cookies

Blink Tuning uses cookies to improve your browsing experience, analyze website performance, and support essential site functionality.

By using our Website, you consent to the use of required cookies. Optional cookies may be accepted or declined. Some third‑party services embedded in our Website (e.g., video players) may also use cookies.

Cookies do not run programs, install software, or deliver viruses. They are used solely for functionality, analytics, and personalization.

3. Intellectual Property & License

Unless otherwise stated, Blink Tuning and/or its licensors own all intellectual property rights for content on this Website.

No link should appear on any website that is defamatory, obscene, criminal, or violates third‑party rights.

7. Website Accuracy & Availability

Blink Tuning does not guarantee that Website information is complete, accurate, or up‑to‑date. We do not guarantee uninterrupted Website availability.

8. Acceptance of Agreement

By purchasing Blink Tuning products or services, you confirm that you have read and agree to this Agreement. This Agreement supersedes all prior communications or representations.

Blink Tuning may update these Terms at any time without notice. The latest version will always be available on the Website.

9. Indemnification

You agree to indemnify, defend, and hold harmless Blink Tuning and its owners, employees, contractors, affiliates, and successors from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising from:

  • Your use of Blink Tuning products or services

  • Your violation of these Terms

  • Any modification or action performed on your vehicle

This indemnification survives termination of your relationship with Blink Tuning.

10. Disclaimer & Vehicle Use

10.1 Installation & Warranty

Modifying a vehicle’s ECU, TCM, or calibration may void your manufacturer’s warranty.

You are solely responsible for verifying warranty implications.

Blink Tuning is not responsible for:

  • Improper installation

  • Pre‑existing mechanical or electrical issues

  • OEM or aftermarket component failure

  • Incorrect use of tuning hardware or software

Professional installation is strongly recommended.

10.2 Vehicle Condition

You are solely responsible for ensuring your vehicle is mechanically sound and capable of handling increased performance.

Blink Tuning is not liable for damage resulting from tuning a vehicle that is not in proper working condition.

If abnormal behavior occurs after tuning, you must:

  • Return the vehicle to stock calibration

  • Stop driving the vehicle

  • Notify Blink Tuning immediately, for us to review calibrations within the first 3 months of flashing the initial tune, or alternatively, bring the vehicle to a Tuner so they can revise calibrations on the vehicle and perform custom adjustments.

10.3 Safety

Blink Tuning is not responsible for unsafe, reckless, negligent, or unlawful driving.

All Blink Tuning products are intended for off‑road and race use only.

You assume all responsibility for compliance with federal, provincial, state, and local laws.

10.4 Off‑Road Use

Blink Tuning calibrations and tuning services are sold for off‑road/race use only.

Any on‑road use is at your sole risk. Blink Tuning is not responsible for:

  • Emissions violations

  • Legal penalties

  • Environmental compliance issues

  • Damage resulting from on‑road use

11. Confidentiality & File Sharing

All Blink Tuning calibration files, tuning data, and datalogs are proprietary intellectual property.

You agree not to share, distribute, publish, or disclose any Blink Tuning files or data logs.

Violation results in:

  • Immediate termination of all services

  • No refunds

  • Permanent ban from Blink Tuning

12. Tune Revision Policy

Initial calibration delivery typically takes 7–10 business days.

Blink Tuning provides a 3-month revision window beginning the day your initial calibration file is delivered, where users may request, up to 3 times, a custom adjustment to their Tune, within Stage 1 or Stage 2 levels. Users cannot have their Tune level upgraded from a lower stage using this courtesy service.

Within this period:

  • Revisions are included for the same modification list as initially provided by the user

  • Changes to vehicle’s hardware may require a Tuning Package Upgrade to a higher tier

  • Revision requests are subject to be accepted or denied at the discretion of Blink Tuning team,
    if deemed adequately justifiable.

  • After the 3-month delay, revision requests may require the user to pay a Custom Tuning fee determined by Blink Tuning team. Revision requests are subject to be accepted or denied at the discretion of Blink Tuning team, if deemed adequately justifiable.

13. Refunds & Returns

All Blink Tuning sales are final at checkout.

Refunds or returns are not offered except in rare circumstances determined solely by Blink Tuning.

14. Legal Disclaimer

To the maximum extent permitted by law, Blink Tuning excludes all warranties, representations, and conditions relating to the Website and its use.

Nothing in this disclaimer limits liability for:

  • Death or personal injury

  • Fraud or fraudulent misrepresentation

  • Any liability not permitted to be excluded under applicable law

As long as the Website and its services are provided free of charge, Blink Tuning is not liable for any loss or damage of any nature.

15.1 Free Access to the Blink Tuning App

Blink Tuning provides its mobile and/or desktop application free of charge.

Access to the app is included for all users and does not require a subscription or separate payment.

Blink Tuning reserves the right to update, modify, or discontinue features within the app at any time without notice.

15.2 Paid Tuning Packages

While access to the app is free, certain features within the app require the purchase of a Blink Tuning calibration package, license, hardware, or service.

These paid packages may include, but are not limited to:

  • ECU tuning

  • TCM tuning

  • Calibration files

  • Revision services

  • Diagnostic or logging features

  • Platform‑specific tuning modules

  • Tuner (Pro) Licenses

Purchasing a tuning package grants you access to the corresponding paid features within the App.

All tuning packages are subject to the same Terms of Service, including the Refund Policy, Indemnification, Disclaimer, and Off‑Road Use provisions.

15.3 App Functionality & Requirements

To use the app, you may be required to:

  • Create an account

  • Connect approved Blink Tuning hardware

  • Maintain an active internet connection during sync operations

  • Use a compatible device or operating system

Blink Tuning is not responsible for:

  • Device incompatibility

  • Connectivity issues

  • Third‑party hardware or software conflicts

  • User error during flashing, logging, or calibration

15.4 App Updates & Feature Changes

Blink Tuning may release updates, patches, or new features for the App at any time.

These updates may:

  • Add new functionality

  • Improve stability

  • Modify existing features

  • Remove outdated features

By using the app, you agree that Blink Tuning may automatically apply updates by making new calibration files available to users in their account, without prior notice. Revisions to existing tuning calibrations will not occur on already-flashed vehicles, these remain untouched.

15.5 Account Security

You are responsible for maintaining the confidentiality of your account credentials.

Blink Tuning is not liable for unauthorized access resulting from:

  • Shared passwords

  • Compromised devices

  • Negligent account management

Suspicious or abusive activity may result in account suspension or termination.

15.6 Prohibited Use

You agree not to:

  • Reverse‑engineer, decompile, or modify the app, and/or any file or software service provided

  • Attempt to bypass paid features

  • Use the app for unlawful purposes

  • Interfere with app functionality or security

  • Share, distribute, or replicate Blink Tuning calibration files or software

Violation of this section may result in immediate termination of access and services without refund.

15.7 App Availability

Blink Tuning does not guarantee:

  • Continuous availability of the App

  • Error‑free operation

  • Compatibility with all devices

  • Uninterrupted access during updates or maintenance

Blink Tuning is not liable for any loss or damage resulting from temporary or permanent App downtime.

16. Professional Tuner Licensing & Bulk Access

16.1 Professional Access Program

Blink Tuning offers specialized licensing for Tuners (“Tuner Partnership Program”, aka “Pro Licenses”) for qualified tuners, shops, and calibration professionals who require expanded access beyond standard user functionality.

Services offered to members of the Tuner Partnership Program may include:

  • Bulk license purchasing

  • Elevated calibration access

  • Advanced or experimental tuning tables

  • Platform‑wide access

  • Additional datalogging or diagnostic capabilities

  • Priority support

  • Multi‑vehicle management tools

Blink Tuning reserves the right to approve or deny Tuner enrollment requests at its sole discretion.

16.2 Eligibility Requirements

To obtain a Tuner access or to become a member of the "Tuner Partnership Program", applicants must:

  • Operate a legitimate tuning business or motorsport operation

  • Provide accurate business information

  • Agree to all Blink Tuning Terms of Service

  • Agree to additional Tuner (Pro) License terms

  • Maintain good standing with Blink Tuning

Blink Tuning may request verification documents such as business registration, shop address, or proof of tuning experience, at the time of receiving an enrollment request, or at any moment during the term of their membership, active or inactive.

16.3 Bulk Licensing

Professional tuners may purchase bulk licenses for use across multiple customer vehicles.
Bulk licenses:

  • Are non‑transferable except to customer vehicles serviced by the licensed tuner, they remain attached (locked) to vehicle VINs and cannot be unassigned unless under very specific cases

  • Cannot be resold, redistributed, or repackaged

  • Must be used in accordance with Blink Tuning’s off‑road use policy

  • Are subject to the same refund and revision policies as individual licenses

Blink Tuning may revoke bulk licensing privileges for misuse, fraud, or violation of these Terms.

16.4 Advanced Access & Restrictions

Tuner account holders may receive access to advanced or experimental tuning tables not available to standard users.

These features:

  • Are provided “as‑is”

  • May require additional expertise

  • May pose increased mechanical risk

  • Must not be shared, copied, or redistributed

  • Must not be used to create competing tuning products

Unauthorized sharing or misuse of accesses will result in immediate termination of all licenses without refund.

16.5 Confidentiality

All services, tools, tables, calibrations, and documentation are proprietary to Blink Tuning, excluding ECU architecture, firmware and hardcoded components, which, in part or in whole, are proprietary to their manufacturers and/or owning entity.

Tuners agree not to:

  • Reverse‑engineer Blink Tuning software

  • Extract or replicate calibration logic

  • Share internal documentation

  • Distribute tuning files or tables

  • Provide access to non‑licensed individuals

  • Use our proprietary software and calibrations, or showcase them, without crediting or mentioning attribution to the provider (Blink Tuning)

Violation will result in permanent termination of access and may result in legal action.

17. Export Controls & Sanctioned Countries

17.1 Compliance with International Regulations

Blink Tuning complies with applicable Canadian, U.S., and international export control laws, including restrictions on providing software, services, or technology to certain countries, entities, or individuals.

Blink Tuning may restrict access to:

  • Countries under trade sanctions

  • Regions subject to export restrictions

  • Individuals or entities listed on government‑issued restricted or denied‑party lists

These restrictions apply to:

  • Software downloads

  • Calibration files

  • Hardware shipments

  • Account creation

  • Technical support

  • Professional tuner licensing

17.2 Restricted Regions

Blink Tuning may refuse service to users located in, associated with, or attempting to access services from:

  • Countries sanctioned by Canada

  • Countries sanctioned by the United States

  • Regions under embargo or trade restrictions

  • Any jurisdiction where tuning software distribution is prohibited

Blink Tuning reserves the right to block access based on IP address, billing information, shipping address, or other indicators. Blink Tuning will not be held as holding discriminatory positions or views based on these actions.

17.3 Customer Responsibility

You agree not to:

  • Access Blink Tuning services from sanctioned regions

  • Use VPNs or proxies to bypass geographic restrictions

  • Export Blink Tuning software or hardware to restricted countries

  • Provide Blink Tuning products to individuals or entities prohibited by law

Violation may result in immediate termination of services without refund.

18. Misuse, Abuse & Prohibited Conduct

18.1 Prohibited Actions

You agree not to:

  • Attempt to bypass licensing or paid features

  • Modify, reverse‑engineer, or tamper with Blink Tuning software

  • Use Blink Tuning products for unlawful purposes

  • Create competing tuning solutions using Blink Tuning intellectual property

  • Misrepresent your identity or business to obtain Pro License access

  • Use Blink Tuning software to harm, disable, or compromise vehicles

18.2 Enforcement

Blink Tuning may suspend or terminate accounts, revoke licenses, or deny service for:

  • Fraud

  • Abuse

  • Violation of Terms

  • Unauthorized sharing

  • Illegal activity

  • Attempts to circumvent security or licensing systems

No refunds will be issued for accounts terminated due to misuse.
